THE TREATY OF NICE

The second referendum on the Nice Treaty will take place on the of 2002. The last time we voted for this the result was NO (54%). What will happen this time? What does rejecting the treaty mean to Ireland and how will it effect our membership of the EU? Do you know what it is all about?

  1. Nice divides Europe into first-class and second-class Members, breaking up the EU partnership of legal equals. It removes the veto we have at present on the French-German scheme for an inner EU State, with its own Constitution, Army and harmonised taxes for the eurozone - which would destroy the basis of our Celtic Tiger economy - and enables them to use the EU Commission, Council, Court and Parliament to call the shots for the rest of us.
  2. Nice means there will be no Irish member on the EU Commission, the body that proposes all EU laws, for possibly lengthy periods. The Big States would lose their Commissioner too, but Nice TREBLES their votes on the Council of Ministers, which makes EU laws, while it only DOUBLES ours.
  3. Nice means that Ireland's choice of an Irish Commissioner can be overruled by the Big States.
  4. Nice militarizes the EU by giving it direct responsibility for the 60,000 soldier Rapid Reaction Force. It makes the EU an alliance for mutual offence abroad, although not for mutual defence.

1. Twenty-sixth Amendment of the Constitution Bill 2002 (Treaty of Nice) proposes in insert after subsection 6 of section 4 of article 29

7° The State may ratify the Treaty of Nice amending the Treaty on European Union, the Treaties establishing the European Communities and certain related Acts signed at Nice on the 26th day of February, 2001.

8° The State may exercise the options or discretions provided by or under articles 1.6, 1.9, 1.11, 1.12, 1.13 and 2.1 of the Treaty referred to in subsection 7° of this section but any such exercise shall be subject to the prior approval of both Houses of the Oireachtas.

9° The State shall not adopt a decision taken by the European Council to establish a common defence pursuant to Article 1.2 of the Treaty referred to in subsection 7° of this section where that common defence would include the State.
